Throughout Scientology's history, SPs have attempted to subvert the tech and prevent people from moving up The Bridge. But again and again, in country after country, those who seek to suppress mankind and thwart Scientology's expansion come up against the one group they cannot overwhelm or beat when they stand face-to-face with the Sea Org.
The Office of Special Affairs network is headed by the Office of Special Affairs International and has offices in each CLO around the world. These units are staffed by Sea Org members, because historically, the safety of Scientology has been entrusted to Sea Organization members - because they have a level of dedication and toughness that is necessary to deal with suppression on the fourth dynamic.
This team of Sea Org members is achieving victory after victory on the external front through the application of standard LRH tech.
There is never any compromise when it comes to protecting the delivery of Scientology in our orgs through the standard application of LRH ethics tech. Being the top of The Bridge, and because of its importance to Scientology and to the rest of the planet, this is particularly true at Flag Land Base. And it was this unreasonable viewpoint which brought about one of the Sea Org's most important recent victories.
The battle centered around a handful of SPs who had waged an unsuccessful campaign to drive the Church out of Clearwater. In the face of Flag's continued expansion, their efforts became even more frantic.
Their suppressive assault began in the mid-1970s when the purchase of the Fort Harrison cut across the plans of local SPs to depress the local real estate market so they could move in and buy up the city cheaply. Reacting to our presence, they pushed through a city ordinance in the

early 80s designed to give the city the power to control and manage any religious organizations finances and operations. Of course, in spite of their efforts to camouflage their bad intentions, it was clearly aimed solely at the Church of Scientology. These officials wanted to be able to move in and take over the Church.
In the early 1980s, a Sea Org Command Team fired to form the Office of Special Affairs at the FLB to deal with these suppressives. One of the first actions was to file a lawsuit against the city.
Not only had the SPs lost and the Church been totally vindicated, but Sea Org members in the Office of Special Affairs had brought about what has been termed one of the greatest victories for First Amendment religious rights this century.
This proved to be only the first skirmish in a tenacious, decade-long battle. Eventually, in September 1993, the 11th Circuit Court of Appeals issued a landmark ruling that protects the rights of all religious organizations throughout the United States. The Court blasted the ordinance and ruled that it had been enacted for an improper political purpose. The Court ruled 100% in our favor. They further found that the ordinance violated a portion of the U.S. Constitution which guarantees freedom of religion in America.
These SPs, however, could not admit defeat. In a last, desperate effort, city officials tried to appeal the case, but the highest court in the land, the U.S. Supreme Court, refused to hear it.
Even then they tried to carry forward with a small portion of the ordinance that had not been specifically declared unconstitutional by the courts. They were willing to continue wasting taxpayer money so they could be right.
The Office of Special Affairs, through the efforts of its dedicated Sea Org members, took the next step to get in their ethics. Special editions of "Freedom" were produced for the Clearwater area. Distributed widely to civic leaders, businessmen and taxpayers, a series of articles exposed the truth and the real motives of those who had been behind this attack.
The truth impinged.
The last few holdouts on the City Commission came to their senses.
They passed a law that officially repealed the ordinance. Scientology was totally victorious and the city paid the Church $635,000 to reimburse all we spent to get their ethics in and bring their illegal acts to a halt.
Scientology is today enjoying unprecedented acceptance and expansion in Clearwater. Clearly, the road to OT will never be blocked in the presence of the Sea Org.
ERADICATING EXTERNAL SPs
No matter where situations arise, Sea Org members work as a team to create a safe environment for Scientology. Keeping the route to OT open means protecting The Bridge at all levels.
In the United Kingdom, for example, one old-time suppressive tried for years to foist his lies about Scientology on the media and others. This year he was completely shut down by the courts. Unemployed and abandoned by his family, this squirrel had schemed to make money by hawking his lies in a book. But the Office of Special Affairs had a court declare his book libelous.
Following a series of legal defeats, he was prevented from distributing his materials, and order to pay the Church more than 70,000 pounds in sanctions, costs and fees. He has now been forced into bankruptcy, joining two others who met the same fate in the last year after they were confronted by Sea Org members and would not voluntarily stop their squirreling.
LEGAL WINS AROUND THE WORLD
In Italy, OSA struck a major blow to the psych-backed enemies who have been trying without success for years to prevent Scientology from expanding in their country.
In a precendential ruling, the Supreme Court shut down attempts by psych-influenced prosecutors to portray the religious activities of the Church as unlawful.
This battle had begun in 1986, after CCHR started to expose the horrendous crimes being committed by psychs in Italy. The psychs recruited an allied prosecutor who ordered raids on Italian Churches and Narconons and closed them down.

Sea Org missionaires from the Office of Special Affairs moved in rapidly to handle the situation. Services were resumed within hours in temporary locations. New quarters were found and the orgs moved into even larger spaces.
This expansion drove the SPs even wilder. The government instigated fruitless "investigations" into the Church and for the next 10 years, to protect the Church and its staff, OSA fought back against baseless charges.
Hard work by Italian OSA Sea Org members and numerous SO missions resulted in a very major legal victory from the Italian Supreme Court. They overturned an earlier suppressive ruling issued by the Court of Appeal in Milan, and recognized the Church as entitled to religious protection under Italian law.
The Sea Org members within OSA would not stand by and allow Scientologists and the Church to be the effect of an SP attack for exercising their religious beliefs.
Another area in the world where suppression has risen to new levels is Germany - the birthplace of Nazi psychiatry. Many of the psychs responsible for massive crimes against humanity escaped justice at the end of World War II. These Nazi psychs subsequently trained others and the second generation SPs have been frantically working to prevent Scientology from expanding and from exposing their crimes.
Through dedicated persistence and standard application of LRH tech, however, Sea Org members in OSA have been making the SPs accountable.
First, they launched a massive public information campaign exposing the SPs to the bright light of world opinion in full-page ads run in The New York Times and The Washington Post. Week after week the perpetrators of the hate campaign in Germany were shown to be the Nazis they are.
And when one of the leading hatemongers published a book filled with libelous statements about the Church, Sea Org members took action. She was sued and her book had to be withdrawn from the market.
This is not the only SP in Germany who is losing.
The Hamburg org had to contend with a ruling concocted by local SPs which prohibited most forms of dissemination in the streets of the city. They too were taken to court. The Hamburg Administrative Court ruled the org's actions were protected by the German Constitution. They also determined that no limitations were to be placed on the Church's expansion actions.

On the heels of that win, the Office of Special Affairs went on to achieve a major victory in the Stuttgart Administrative Court of Appeal which confirmed the Church's right to disseminate and forbade all government attempts to hinder Scientology's expansion.
Though timely, these victories were only the beginning.
A special German edition of Freedom magazine was produced which documented and exposed the sources of attacks on Scientology in Germany - the former Nazi psychiatrists who had once practiced their deadly trade in the concentration camps.
A million copies of the magazine were distributed throughout every major city in Germany. State ministries, banks, political parties, trade unions, federal ministries, Catholic centers, universities, police stations, state security offices and federal criminal police offices received copies.
And following this massive onslaught to expose the truth?
Once again, the victory originated in Stuttgart. Starting in 1986, the city government had attempted to stop the expansion of Scientology by "deregistering" the Stuttgart Mission of Neue Brucke (New Bridge) - stripping it of its religious status.
Under the direction of Sea Org officers in OSA, the case was brought to court. The result was a complete reversal of the 1986 decision, decreeing it illegal and in violation of the German Constitution's guarantee of freedom of religion.
That decision made headlines across Germany.

"Stuttgart Loses to Scientology."The Stuttgart decision sent a clear-cut message that discrimination against Scientologists was forbidden and told other courts exactly how they should rule.
ERADICATING PSYCHIATRY
Handling the planet means putting ethics in on the real source of enturbulation in this universe - the psychs. Although we have had to deal with these whole track implanters for a long, long time, the only thing which has ever effectively stopped the suppressive influence of psychiatry has been the ethics presence of the Sea Org.
Knowing this, the Sea Org executives of OSA International launched a campaign to once and for all bring an end to the influence of psychiatry on society. Psychiatrists commit crimes on a daily basis. Their victims can get them prosecuted and sue them civilly. With enough convictions, it will become clear that these criminals must be legislated out of existence.
To this end, assistance has been provided in government agencies in their investigations of psych facilities. As a result, 33 psych hospitals have been closed down in the United States.
And to further help nail the psychs coffin shut, the first of a new series of publications has been released which exposes their racist history. Entitled "Psychiatry's Betrayal: Creating Racism," this booklet shows how for more than two hundred years, psychiatrists have claimed that "inferiority" is somehow inherent in certain races, including the African race.
The psychs are already on the run. After the booklet was released at a press conference in South Africa - and covered widely in the local media - a whistleblower from a nearby black mental hospital housing thousands of patients called in to report that sudden inspections and clean up were in progress by institution staff.
The SPs are getting the message: their days are numbered.
SAFEGUARDING THE FUTURE
The examples above touch upon just a few of the areas where Sea Org members are making their impact felt in the world community. Our ethics presence is greater today than it has ever been. We are bringing a safe environment to earth where tech can go in and The Bridge is wide open.
Our target is an ambitious one - an OT civilization - but it's a target we must achieve. The Sea Org is the only group which can accomplish it.

We've made the ethics presence of the Sea Org real on the planet: and we must continue to do so. ... I am sure now we will put standard tech and standard policy in solid and continue our ethics presence by blasting the SPs still kicking around."

In the past decade, Hamburg Org has been one of the most successful Scientology Class V orgs on the planet. From the time it became an org in the mid-80s, it expanded rapidly to Saint Hill size and is now about 10 times as big as when it opened its doors as a Class V Org.
Over the past two years, however, the rapid expansion of the 80s slowed down, and the org came under increasing external attacks. The city of Hamburg had even issued a decree through which it attempted to prohibit the orgs broad public dissemination. There are two approaches to handling such a situation. The Sea Org addressed both. While the Office of Special Affairs dealt with the SPs, a thorough review was done to isolate the internal causes.
It is, of course, true that suppressives, especially those with Nazi leanings, go berserk in the face of a flourishing and prospering Scientology activity. However, there also is another stable datum - an org is in control of its own environment. Standard ethics, tech and admin generates a field that is so strong it will prevent external attacks.
Therefore, a team of senior SO veterans fired to Hamburg to get to the bottom of whatever had slowed down the rate of expansion, find what external influences were in the way of the org expanding its reach, and what handlings were necessary to get 100% standard tech applied.
The first action of these missionaries was to find and handle any immediate internal out ethics. Sea Org ethics standards were enforced. Standards ethics filing was done per HCO Policy Letter, Ethics Officer Hat. This quickly brought to light any off-policy and out-tech situations and identified those responsible for them. Hamburg Org staff had phenomenal wins from the standard, no-nonsense application of ethics technology in Sea Org style.
The reports also isolated several external influences that had latched onto the org for their own purposes. This, of course, is not looked upon kindly by the Sea Org. Orgs exist so people can go free; they are not there for any other reason. These individuals were immediately gotten off the org's lines.
Simultaneously, the SO missionaires dramatically increased promotion. They upgraded Source image throughout the org. Standard course schedules were enforced, auditors and C/Ses were corrected on any confusions or departures from standard tech. And all the while, any out-ethics was instantly found and handled wherever tech would not go in.
There were immediate improvements in the quantity and quality of Academy and HGC completions, with tremendous wins and rave success stories.
The staff were all put through the Success Through Communications Course, standard administrative actions were put in with the org Exec and Ad Councils. Routine Source briefings and events were implemented to keep the staff and public briefed and constantly remind them of the miracles of the application of LRH's technology.
The org got back on track, on Source, and the rate of expansion reverted. The external situations began to resolve. But when the Sea Org deals with a situation, it handles the hell out of it. Thus, Sea Org management not only handled the immediate situations, but implemented a handling to bring about a "Clear Hamburg" in short order.
A highly qualified SO Command Team, consisting of seven veteran SO executives, was sent to Hamburg to head the org and the networks and make Scientology flourish and prosper beyond previous expectations.
The effectiveness of the Sea Org made media headlines. Within a matter of days of the Command Team's arrival, the main Hamburg newspaper and national TV reported on the fact of the Sea Org's plans to 10X the rate of expansion of the Church of Hamburg and North Germany.
And, as described in the article on page 36, "Handling Suppressives on the 4th Dynamic," the external attacks were turned into victories.
The final triumph of ethics and standard tech occurred when the Hamburg court demolished the city of Hamburg's prohibitive decrees against the Div Six outflow actions. The court cancelled the decrees and opened the doors for the org to promote Scientology in every available manner and with no further limitations.
With the Sea Org getting in standard ethics, standard tech and standard admin, there is no opposition big enough to prevent us from accomplishing the aims of Scientology.

The Sea Org "Mission" of the "OSA" man Will Duckhorn at Burgbrohl - 1991
After the youngest son of Scientology boss Ron Hubbard, Arthur, who lived for almost a year at the Helnwein castle in 1990 and diligently painted and also set up other work for him, another American from Los Angeles came to stay with Helnwein. His name: Will Duckhorn, a large, somewhat heavyset man with short, gray-streaked, black hair. About 50 years old. He was introduced to the Helnwein assistants as the new "administrator" who was supposed to finally bring Helnwein's organizational system in Burgbrohl up to snuff, the system which, for whatever reason, did not function according to Helnwein's taste or that of other interested parties in the USA.

Will immediately introduced the "basket" system, i.e. orders inside the castle went to the appropriate staff members through new order forms which Will introduced, and which gained him little support from the staff members there. Helnwein's former partner, Reichelt, asked him immediately upon meeting him where he came from and what was holding him down to the little "cowtown" of Burgbrohl. He learned that Will was a very open, talkative man, such as one would expect of a typical, average, somewhat homely American. "He was always extremely friendly, good-humored and ready to help, and when I saw that he had nearly unlimited access to all rooms on the Helnwein premises, I was particularly surprised," Reichelt was able to report. Duckhorn very quickly turned into "man Friday,"

despite a certain ever-present authority in relation to the Helnwein couple. To Reichelt, their stately behavior towards each other did not appear to be beyond any doubt. More like certain forces were being tolerated. Will, the "administrator" who also spoke some German, told a Helnwein assistant that he had been sent from Los Angeles to Burgbrohl. Reichelt: "He presented himself to me as a member of the Scientology Church International. He asked me in return if I was also "in Scientology," which I truthfully denied without justifying it any further. After I had told him that I had been to Hollywood a few times and knew my way around there. Will told me that his office was on Hollywood Boulevard in the organization's headquarters, He also knew Arthur really well from Los Angeles, where their paths crossed often. The American Scientology envoy from the distant headquarters was "on mission" in Germany.
Kurt Fliegerbauer - Scientology and the Expansion into the East
Will Duckhorn not only checked out and "oversaw" the Helnwein couple, but was primarily interested since at least late summer 1991 in other financially well-off friends of the Helnwein family like, e.g., Kurt Fliegerbauer, a successful construction tycoon who, like Helnwein, was a high "OT" and Flag graduate. Fliegerbauer, a man from Munich, a great admirer of Gottfried Helnwein's art and proud owner of an extensive collection of Helnwein pictures, had continued to buy from him, especially since 1991. He was not only taken with Helnwein's art, but also by real estate which appeared particularly lucrative in the "new" German states, reported in detail by writers Liane v. Billerbeck and Frank Nordhausen in "Stern" magazine, issue 7 of February 1996 in their well-researched article "Scientology - their god is called money" as follows:
The psycho-sect is steadily moving into the real estate business. Scientologists are buying up entire sections of downtown in eastern German cities cheap to make a profit with renovations. That is how it started in Zwickau; will that be how it goes in Goerlitz? [...] Kurt Fliegerbauer, whom some call the "godfather of Zwickau," is nervous. He has become a topic of discussion; behind the eccentric investor is said to be concealed a dangerous sect: Scientology. Many Zwickau residents are afraid of this uncanny power.

"They have bought up half the old town," said one. At the end of 1995 the town council pulled the emergency brake and stopped the sale of municipal land to Fliegerbauer's "Osterstein Castle Management, Inc." Osterstein Castle, a structure from the 13th century which towered over Zwickau's center, was in a state of decay. The smartly dressed resident of Munich, who appeared in Zwickau in summer 1992, wanted to change that. Kurt Fliegerbauer introduced himself [...]as an investor who wanted, "to keep Osterstein Castle from collapsing in ruin at the last minute." A hotel was to arise from the historic cell blocks [...]. The town fathers were enthusiastic. [...] Fliegerbauer acquired the city landmark in December 1993 at a discount price of four million marks. [...] In April 1994, excavating equipment was brought in and work was started. [...] In December 1994, Fliegerbauer sold Osterstein to the "Holzmindener Fertigbau, GmbH." [...] [In January 1995] the alert Bavarian man had changed tack. Fliegerbauer had begun to buy historical buildings. Most of them cost about 300,000 marks, but were often worth over one million after having been renovated. While Osterstein Castle was being ruined, "Osterstein Castle Management, Inc." was blooming. By the end of 1994, it already owned thirty renovation properties, by winter of 1995 about 120 buildings. 500 men were employed at the construction sites. All the same, more and more rumors were making their rounds in Zwickau. [...] There was talk of peculiar goings-on in the Fliegerbauer firm. Staff member Regine Meier (name changed by editorial staff) told of enormous pressure on the 26 employees: "we had to work many hours of overtime for which we were not paid." A so-called "Org Board" hung on the wall, a chart which contained absurd sentences like "Communication delivered quickly and accepted without condition." "Statistics meetings" took place on a regular basis. Everyone had to read their "work statistics" out loud. Regina Meier: "mail received, mail sent out, telephone calls."
Some people thought that was funny/strange. [...] Ursula Caberta, Scientology expert of the Hamburg Senate, regards Fliegerbauer's practices as "the implementation of Ron Hubbard's so-called management technology." The founder of Scientology recommended pressure on the job, the Org Board and the principle of the "rising statistic" for the total control of a business.
Tom Voltz said that Kurt Fliegerbauer was a "100 proof Scientologist." "At the time he had ordered WISE material from me, too." Apparently the Fliegerbauers have an entire group of sect people employed in Zwickau. Fliegerbauer founded his Osterstein Association with Munich Scientologist Guenther von Jan, who leads an attorney's office on well-to-do Prinzregentenplatz. A fax from July 195 shows that the attorney even has connections with the "Office of Special Affairs" (OSA), the Scientology secret service. Scientologists are also employed in the operations of Fliegerbauer's buildings. Sometimes they are even sold within the sect. [...] Nevertheless, the activities in Zwickau are only a part of the Scientology operation in the new German states. [...]
[I]n October 1993, Ulrich Schulz from Altenburg read an advertisement, "Multi-family building sought. Will pay in cash." Schulz, who was learning the ropes as a real estate broker, named a price and landed in a mess that almost ruined him.
Mario Herold
He met up with Mario Herold from Wuppertal, who ran a business consulting firm in Leipzig and dealt in real estate. Herold, a huge man in his mid forties, introduced Schulz to his business partners, who gave the impression of solid wealth. These kind of "friends," Schulz' son Mirko learned, were active all over Sachsen: Fliegerbauer, for example, who managed a real estate company in Zwickau with Herold. Herold's group wanted to build a large business complex in downtown Leipzig, the "Gutenberg Galerie." By 1994, [...] Herold's company had acquired about forty pieces of real estate in and around Leipzig. Ulrich and Mirko Schulz founded a construction company in which Herold had a part. Schulz junior did indeed wonder about the "odd language" and the "piercing look" of the gentleman, but he chalked it up to whim. [...] Herold's employees in Leipzig also began to notice where their chief got his direction from. "A lot of mail came from Scientology which they did not want us to open," said staff Boettcher (name changed). Herold also tried to recruit his employees. Boettcher said, "Almost everybody took the personality test" - the way disciples were currently being roped in. Herold and Fehling belonged to a web of companies aligned with Scientology which bought buildings in the Leipzig area to dispose of them profitably after renovation - a "Mafia with very strict rules," as Boettcher said. dollars to Scientology to operate as a "Thetan." Adlatus Axel Fehling is also a member of WISE.
The gentlemen value, as capital assets, the pictures of painter Gottfried Helnwein, who even appeared personally in Leipzig. "Herold had bought certain paintings from him for a quarter million." Millionaire Scientologist Klaus Kempe is also another Helnwein fan.
Helnwein in Court - 1991 to 1997
On June 6, 1991 a detailed article appeared in a local Burgbrohl paper, the "Ohlbruecken - Rundschau," entitled "Why are Alarms sounding in Brohl Valley?" which revealed and criticized Helnwein's Scientology activities at his residence.
That local report set off a string of lawsuits which is still going on today, initiated and carried through by Gottfried and Renate Helnwein, with excellent support from their Duesseldorf attorney, Christian Reinking, against critics who publicly, "falsely" accuse the Helnwein couple, in any way, of being members of Scientology or of conducting activity for that organization.
This had been possible for journalists who published the truth innumerable times worldwide about Gottfried Helnwein between 1972 and June 1991 without any fear of recrimination. The last time that "succeeded" without harsh, legal consequences or persecution was in June 1989, in the "BIO" newspaper in an article by chief editor Michael Geffken. That interview, in the form of a "home story," was the sole exception. It was the only time that Gottfried Helnwein publicly admitted to being a Scientologist to a journalist of a "non-Scientology" magazine, or in Germany at all.
In summer 1989 (!), Geffken wrote, " ... Back in the studio, back to the question of what Helnwein wants to accomplish with his art. "People have perfect repression mechanisms, but artists don't." So does he want to get across what is true for him to people? In asking this question, we are in the worldview of the painter. What does he do for spiritual health? Helnwein: "I take Scientology courses." Why? "Because it is a very clear, very exact subject." How did he get into Scientology? "With Zen Buddhism.

Buddhism is the highest standing religion, a religion which does not believe in gods and spirits, which does not issue any kind of rules according to which you are punished or have your hands cut off. For me, Scientology is a progression of Zen Buddhism." My confusion grew. This man who controlled even the smallest stroke of paint brush, an adherent of a sect? Helnwein became cross at use of the "sect" label, "Scientology is not a sect - only opponents say that, the zealots from the Christian Churches!" Then what is Scientology, what does he personally get out of it? Helnwein responded, "For me it is a way to my personal integrity. I want to lay aside my automatism and live fully aware, spontaneous and self-determined. From my point of view, Scientology has founded a natural ethic, a philosophy of reason." The picture has been rounded out for me here at the end of my visit to the castle. I have learned: even rebels need a religion, and clever rebels need a clever religion." Did Helnwein "infect" writer Geffken with Scientology? One could almost believe that.
Only 24 months later writer Geffken would have been confronted with a legal "temporary restraining order" with a value in dispute of 250,000 DM, made possible only by Gottfried Helnwein's punishable, semi-deliberate, false sworn affirmation, which would contain the following, tailored to each situation, "I do not have an office, post and function or active membership in any kind of religious congregation, political party, church or sect, especially not with Scientology." So it went in more than a dozen court proceedings in Germany between 1991 and 1995.
The beginning: court proceeding No. 1, "Helnwein vs. Evangelical Church et al." was publicly heard, file number 1 0. 341 / 91 on the 11th of July 1991 before the 1st civil chamber of the Koblenz State Court and ended with a settlement partially in favor of Helnwein.
What had happened? On June 20, 1991, in the "Ohlbruecken - Rundschau" daily paper an article appeared, "Why are Alarms sounding in Brohl Valley?" Journalist Schneider wrote, " ... Reverend Keden (Director of the people's missionary office in the Evangelical Church in Rheinland in Duesseldorf) indicated that the sect has now increased its activity on the open countryside because it is running into inexperience and uncertainty there. Hans Peter Muessenich, presiding Deacon and district minister in Brohl Valley, mentioned the connections as far as he could see. In doing so he included the "castle", an estate in

Gottfried Helnwein, the internationally acclaimed artist, who has been living in Burgbrohl since 1985 and has chosen the local castle for his domicile, took a stand in a press conference on the rumor floating about the Brohl valley community that alleges he is employed as a "missionary" for the "Scientology Church" in this vicinity. Such assertions, said the artist, are the product of a campaign of slander against which he will defend himself, using legal means if he has to.

Young people, Evangelical minister Gerhard Jankowski (Bad Breisig) lets us know, feel very well at the "castle," there is "great help" for them there. That is making the assumption, says Reverend Kaden, that use is being made of the recruitment possibilities being offered. Membership recruitment took place with every young person from Brohl Valley whose parents voiced their concern. Asked about conspicuous changes in her child, the mother answered, "Mostly what bothered me was her fixed stare." A short time later Helnwein took a stand on this in the local press and rejected the accusations. The local press wrote of it, " ... It was claimed, said Helnwein literally, "missionary activity for 'Scientology' was being conducted from the castle." Helnwein replied yesterday, "I am against the principle of missionary work and would not like to be used for recruitment of a religious nature." He initiated legal steps and stated under oath that he never tried to recruit young people and that he had never been engaged in missionary activity. His staff also stated under oath never to have spoken about 'Scientology' to Helnwein. Helnwein spoke of a "campaign (!) against me and my family." He has exhausted all legal alternatives and, if necessary, will take whatever steps are necessary to counter such presumptions. The campaign had allegedly been carried out for a year (summer 1990), since the time when his idea of creating a comic museum and art center (!) in Brohl Valley became known. Now his project in Brohl Valley is no longer a topic of discussion. Life for him and his family has become difficult."

SWORN STATEMENT
1.) I do not have any office, post or function in any religious congregation, political party, sect or denominational society of whatever sort.
2.) The building in the "Eifel" where I live with my family serves exclusively as a photography and art studio to create and present art and as a residence for me and my family, consisting of my wife and four children. This can be verified by hundreds of witnesses at any time. It does not serve for the dissemination of teachings of any kind of religious society or sect.
3.) No religious society, political party or sect is authorized by me to use a picture of my person, art, expressions or text for advertising purposes.
4.) I am of the firm conviction that in a democratic society everyone has the right to decide for himself if and what worldview or political, philosophical, artistic or religious concepts he wants to represent so long as he is not restricting the freedom of others by doing so. I am absolutely against any type of coercive missionary work or tutelage.
Anybody who is familiar with my work knows that I have committed myself against violence and intolerance with my art for over 20 years. Therefore the assertions that I would want to proselytize to the inhabitants of Brohl Valley are sheer nonsense and are without any foundation.
I have never tried to proselytize to any citizen or young person from Brohl Valley.
From now on, I will proceed using legal measures against anybody who spreads the untrue assertions about me.

At the conclusion of the "Helnwein and his Sect Castle" affair, Reverend Kaden, for the Evangelical Church of Duesseldorf, published a supplementary press release on July 16, 1991: "On June 13, 1991 the ministers association of the Catholic Church in Weiber held a press meeting regarding the Scientology Church (SC), in which Reverend Keden of the Evangelical Church attended as sect commissioner, and in which Reverend Jankowski of the Ev. Church Association of Bad Breisig participated. After increased activity in Brohl Valley - it dealt with pointing out the public activity of the SC and letting people know of the danger associated with this organization, which is known as a sect. In the course of the press conference, the topic came up of Helnwein, the renowned painter who lives at Burgbrohl and who is known to be a member of the SC. Mr. Helnwein felt that he had been demeaned by an article which was published in the "Ohlbruecker Rundschau" after the press conference, and initiated legal proceedings against Mssrs. Keden and Jankowski, and the Brohl Valley publishing company, with the intention of having all three parties desist from making or distributing the following assertions by word or otherwise:
- that Mr. Helnwein was trying to recruit young people as members for the SC.
- that an effort was being made at the Burgbrohl estate to recruit young people for the SC
- that attempts at recruitment had already been successfully made with young people at Burgbrohl.
Furthermore it was stated that expression or distribution of assertions which gave the impression that the Burgbrohl estate was to be regarded as some sort of "sect center" in which members were being recruited for the SC should cease. The hearing for these proceedings took place in Koblenz State Court on July 11, 1991. Mr. Keden and Mr. Jankowski emphasized that they had not made the incriminating statements. It would be much more correct, stated Mr. Keden, to say that he had described Mr. Helnwein as an SC member who played a role in that sect ... After Mr. Helnwein and the publishing company settled out of court, the legal dispute with the two accused gentlemen was said to be over."
Because this "only" dealt with a temporary restraining order, the correctness of the claims was not further reviewed by the court. That would have been possible

later in a principal proceeding in collecting evidence. That was foregone. Therefore the factual finding remained unsettled. Scientologist Helnwein had attained his goal. His opponents had been intimidated and had tucked in their "tails." As of 1991, the new, unfailing Helnwein tactic in public was "I am not now nor ever have been a Scientologist." It succeeded the first time. His martyr's role had begun. ... The public was to be unsettled in its opinion about the actual role in the SC organization. Heavy doubts abounded... Perhaps he really was innocent? This view was maintained for a long time, until ..., yes, until the press statement by the US SC headquarters press office in January 1997.
The Persecution of Journalists
The May 1996 issue of "Journalist" trade magazine wrote under the title story "With Argus Eyes - Media and Sects", "Journalists who are engaged with the theme of "sects" can prepare for a few things in advance. Being threatened with legal measures is one of the harmless variants of reactions. Anyone categorized as a sect critic will learn of totally different methods from the subject organizations: deliberate misinformation, attempts to intimidate up to psycho-terrorism. The Scientologists are especially well known for having developed a refined repertoire in dealing with critics..." Editor Hans-Joachim Maes further described sects' dealings with their "enemies":
"A radio broadcasting staff member reported on a supposed connection of sect members to an airline company. In this regard he cited staff of the 'trust arrangement' and other people who could confirm the suspicion. In that case the sect solved the problem by using legal pressure. The journalist, an independent professional, was threatened with a 'Temporary Restraining Order' (TRO) and a lawsuit for a large amount in damages, a retraction was demanded along with a legal obligation to cease and desist. A lawyer, in the course of his profession, uses a 'TRO' as an instrument to temporarily restore the legal peace again. In this actual case the attorney proceeded quite differently by assigning a high value of dispute and requiring immediate decision to determine expenses. The consequence was that expenses of several thousand marks were racked up within several days of the event. The staff member retracted everything he said and signed a dubious 'sworn affirmation.' By his doing that, the other side was saved from the expense of carrying out the legal proceedings. Lesson learned: sects often misuse the law.

They initiate 'temporary restraining orders' with false 'sworn affirmations.' The initial hearing judges only the credibility of the presentation that a law has been violated, not actual proof. Victims of such an action not only are faced with court costs but are straddled with work. ... Sects open with the fervor of a 'stage set for near war.' Unfortunately, journalists continue to fall for that" such as has been amply demonstrated with the Helnwein case in countless publications in "pro Helnwein" Germany since 1991, thanks to his refined technique of silencing critics through complex court proceedings.
In 1991, almost 20 years of openness and "non"-lies about his Scientology activities were gone. And that was primarily for economic reasons. 1990/91 marked the start of overdue, increased, public proceedings against Scientology members and the evil machinations of their organization in Germany. Suddenly art buyers, galleries and even museums did not want or need to cooperate with artists who publicly recruited for Hubbard and his organization, as Helnwein had done a hundred times over almost 20 years.
In the narrow confines of a meeting, in spring 1991, of the German Scientology secret service, DSA/OSA (Office for Special Affairs), according to a statement by a former German member of the OSA, it was decided that their most prominent member in Germany, Gottfried Helnwein, would be "permitted" to "publicly" lie, using any means, about his membership without having to worry about being punished by immediate exclusion from the Church. Intentional lies about the matter were immediately made an option. Years later, in 1995, this process was also verified by ex-Scientologist Jeanette Schweitzer in the Helnwein case.
As far as Helnwein was concerned, this formulation of the "truth," i.e., lies about his Scientology past, lies in the form of repeated contention of his membership "in Scientology," was the only remaining way to economically survive in Germany in the 1990s. He really had imagined it somewhat differently.
However, in all the excitement of suppressing and white-washing his past, Helnwein probably forgot that his 20 years of intense, public appearances for Scientology all over the world had left manifold traces, detectable traces, in his wake. That was not to

Ursula Caberta y Diaz presides over an anti-Constitutional office which spreads hate against religion at taxpayers' expense. For five years, until June 1996, he rode a giant wave of success through the paper forest of the media as an undisputed "non-Scientologist" and as a "poor, innocent victim" over more than a dozen court proceedings, in which he was assisted in his success, thanks to the cooperation of many good "Scientology minds," by false testimony and shameless exploitation of his oh-so-evil critics who were having trouble with the complicated material because of their unfamiliarity with it.

Renate Helnwein is OT 8 - 1988
Renate Helnwein also liked "suing critics" as a means of defense. Adelheid Rech-Gesche, who is the chief of the "Celebrity Center," like her best friend Renate, became a proud "Operating Thetan VIII" in fall 1988, thereby achieving the highest possible level in the scope of the Scientology course system. Taking the course is possible only on the "Freewinds," a ship accessible exclusively to high-ranking Scientologists which sails primarily off the waters of Florida's coast. Being permitted to board this ship is the highest honor which any Scientologist can have. The maiden voyage had just occurred in 1988 and, what an honor, both women, thanks to generous "donations" to Scientology, were allowed to "be there" in the same year. To be sure, a prerequisite was many years of extremely intense study of the Hubbard teachings.
Both women are in the the small, exclusive circle of the top Scientologists by having the highest possible training level of OT VII.
Gottfried Helnwein, who had just become "Clear" and OT I in 1974, celebrated 1989 at OT V, just three levels away, on the verge of reaching OT VIII. That means his wife, in 1989, was three levels above him in leadership. In a legally binding judgment by the Cologne Superior State Court on June 29, 1993 (AZ 15 U 54 / 93), the judges stated in the basis of their decision, "In .. the ... statement that the Scientologists had listed Renate Helnwein as an "Operating Thetan VIII", that is indisputably an assertion of fact. But because Gottfried Helnwein was listed along with his wife, Renate, on a "Patron List" of the Scientology Church's "Impact" magazine, and the only people who are put on the "Patron List" have put a minimum of $40,000 in the War Chest of the IAS, the International Association of Scientologists with their main office in England, then a clear suspicion has arisen that Gottfried Helnwein, in reality, may be lying to cover up a close association with the organization. ... With regard to that and the payment of the considerable amount of money associated with being put on the "Patron List" to the organization, one may infer that Renate Helnwein actively intercedes on behalf of the mission goals of the Scientology Church...".

A Synopsis of all the Helnwein Legal Proceedings
Many other legal proceedings were to follow. A summary of cases is presented, insofar as it is known, of the court proceedings initiated by Gottfried Helnwein in Germany between 1991 and 1996 which contain Helnwein's sworn affirmations:
1. Saarbruecken State Court - file number: unknown, 1994, Gottfried Helnwein vs. "Verein fuer die Interessen tyrannisierter Mitmenschen e.V." and the "Verein fuer Friedenserziehung im Saarland e.V."
On March 21, 1994 Gottfried used his "written, sworn affirmation" to apply for a temporary restraining order. On March 31, 1994 he withdrew his application because the court will not decide without an oral hearing.
Suspicion of false sworn affirmation by Gottfried Helnwein and trial fraud, because Helnwein is, in fact, a "Class IV Auditor."2. Bonn State Court - file number: unknown, 1994, defendants same as above, reason same as above.
On April 20, 1994 Helnwein managed a "TRO" without an oral hearing. On July 20, 1994 Helnwein withdrew the reason for the "TRO" and waived rights on the order. In both proceedings, Gottfried submitted his sworn affirmation as a basis of credibility. In his TRO of March 14, 1994, he stated, among other things, " ... At no point in time was I or am I a 'Class IV Auditor...'. Proof: basis of a decision of the Frankfurt Superior State Court on accounts of Gunther Traeger, Adelheid Rech-Gesche, the Director of the Scientology Celebrity Center in Duesseldorf, a statement by the Scientology Organization, et al.
Suspicion of false sworn affirmation by Gottfried Helnwein and trial fraud, because Helnwein is a "Class IV Auditor."3. Frankfurt am Main State Court. file number: 2/3 O 507 / 94, 1994, appealed by the accused parties to

Application for a temporary restraining order of October 9, 1992 with the sworn affirmation - attachment 4 - by Gottfried Helnwein of October 9, 1992. Items 1 and 2 of the affirmation are false, because Helnwein, together with his wife, donated $80,000 to the War Chest of the Scientologists. Helnwein is an "Operating Thetan." Cologne State Court made the decision of October 9, 1992 based on Helnwein's false affirmation. Suspicion of false sworn affirmation by Gottfried Helnwein and trial fraud, because Helnwein and his wife have been "Patrons" since 1988 and therefore have together "donated" min. $80,000. Besides that, Helnwein has been an "Operating Thetan" since 1974.6. Heilbronn State Court, file number: 5 O 2548 / 92, 1992, Gottfried Helnwein vs. Hans-Gerold Goebbel and Junge Union Baden W.
On October 11, 1992 application for "TRO" with sworn affirmation by Helnwein of October 9, 1992 - attachment 6 - permitted by the court based on credibility of Helnwein because of his oath. Temp. restraining order decided without oral hearing in favor of Helnwein on October 12, 1992. Attachment 6 submitted for the TRO is false in the following items, "I do not have ... an active membership ... in Scientology." That is false. Helnwein has been a member of the Scientology Organization without break since 1972. Indeed, Helnwein was still being described on January 14, 1997 by the Scientology Organization as a persecuted Scientologist. There is no question of there having been a break in membership. The decision was rendered legally effective by the closing statement. Suspicion of false sworn affirmation and trial fraud.7. Koblenz State Court, file number: 1.O.558 / 91 1991, Gottfried Helnwein vs. Holger Brosius
On November 13, 1991, Helnwein submitted the application for a "TRO" and justified it by means of his sworn affirmation of the same day. Without oral hearing on November 14, 1991, the court issued the following temporary order: the following assertion will be avoided: "recruitment attempts by the Scientology Church have taken place on the Burgbrohl of painter HelnweinHelnwein & Scientology, Lies & Treason by Peter Reichelt, 1997 - Page 331
or attempts to build a sect establishment in its vicinity have been going on for a long time." Nevertheless, both of those statement correspond to fact. Therefore Helnwein's sworn affirmation is false. Suspicion of false sworn affirmation and trial fraud.
8. Koblenz State Court file number: 2.O.502 / 91 1991 Gottfried Helnwein vs. Verlag Gruner and Jahr AG and Co.
On November 15, 1991, Helnwein filed the same application as he did under item 7. He then established credibility, in turn, by means of a TRO. On November 19, 1991, the court decided in favor of Helnwein's TRO. This "sworn statement" - attachment 5 - is also false in the following points: "The building in "Eifel" in which I reside with my family is used exclusively as a paint and photo studio. ... It is not used to spread the teachings of any kind of religious society or sect. ... So the assertion that I would want to proselytize to the inhabitants of Brohl Valley is pure nonsense and without any foundation. ... No religious society ... or sect ... is authorized by me to use a picture of my person, art work ... statements or text for advertising purposes. ..." Exactly the reverse is true. Recruitment for Scientology has been done in the castle under Helnwein's direction since 1985. A Scientology Celebrity Center was established in Burgbrohl the beginning of 1985. Countless Scientology publications have been advertising in detail with Helnwein's statements, art work, interviews, photos, etc. from 1974 until today! Suspicion of submitting a false sworn affirmation and trial fraud by Gottfried Helnwein.9. On June 28, 1991, Helnwein filed an application for a temporary restraining order. On July 11, 1991, the parties to the procedure reached a partial settlement. The Brohltal Verlag publishing company was forbidden to again make three specified assertions. However, according to statements by various people close to Helnwein, points 1 and 2 as specified were true. Helnwein again based the credibility of his statement on a TRO. Suspicion of false sworn affirmation and trial fraud by Gottfried Helnwein.

I am a member of the Roman Catholic Church - having been educated in a cloister kindergarten and in a cloister school of the school brother order ["Schulbruederorden"] and with the Jesuits in Vienna.
During the time I was in high school with the Jesuits, I heard of priests of this order who went to Japan and meditated in the Zen Buddhism cloisters for years, even became Zen masters, and did this with the permission of the Jesuit Order and in accord with the Catholic Church. Excited by a conversation with a Jesuit father, I also began to be interested in Zen Buddhism, Taoism, and later in Yoga and Scientology. I read many books on these subjects and took a few courses in Yoga and Scientology. That happened as a result of personal interest and curiosity.
I was a (passive) member in a Yoga association as well as in Scientology in order to be able to take their courses (as one, e.g., is a member of a book club to acquire certain books).

I am currently occupied with the Talmud and the Kabbala, which does not mean however, that I intend to found a Jewish cultural center or a Synagogue here.
My philosophical studies are of a purely private nature and are part of my intimate sphere. What other people are occupied with, why or whether they believe anything in general, has never interested me, and I decisively reject any form of coercive missionary work or religious zealotry.
2. Therefore it is completely incomprehensible to me why some people have been trying for two or three years to discredit me in that they spread the false assertion that my residence and my studio are a sect center and that I am trying to recruit people for Scientology.
In order to protect myself and my family, and above all my four children, from hostilities, aggressions and attacks, I have applied to the Koblenz State Court to effect a Temporary Restraining Order against the Olbrueckrundschau newspaper, which has published this kind of assertion.
The Olbrueckrundschau was immediately ready to sign a cease-and-desist order, and had not even tried to raise an objection, because the Protestant ministers quoted by them testified in court that they had never made those statements and would not make them in the future.
3. Now Mr. Brosius from the neighboring village of Niederzissen is repeating similar assertions against me, namely the assertion that I am recruiting for Scientology on my estate. Because Mr. Brosius, to my knowledge, does not know me at all, he is relying on second-hand information. He is relying on Mr. Norbert Potthoff, who, as far as I know, has never set foot in my house. have only seen him a single time for a couple of seconds in the house of my neighbor at the time, Mr. Rudolf Kruspel, and said "Guten Tag" - that was all.
4. I would like to set the folowing [sic] straight in regards to Mr. Norbert Potthoff's written sworn affirmation.
The basis of the error (the false testimony?) of Mr. Potthoff is his ignorance (refusal to say?) that there are two different castle buildings in Burgbrohl. Castle 1, the former winery, belonged to native residents Mr. Sahl and Mrs. Lauer until 1989. Between April 1985 and 1987, this Castle 1 was rented to Mr. Rudolf Kruspel. In contrast, I rented Castle 2 (the Castle) in 1984 (not in 1985) and moved in with my wife and children that same year (Mr. Potthoff's time line is already false). If Mr. Potthoff continues to maintain that I have put a room in my castle at the disposal of the Scientology Church, then that is also false. Neither I nor my wife have made rooms or other areas available to the Scientology Church for courses, auditing or recruitment. Neither have we ever tolerated those kind of activities in our rooms / in our areas.
Mr. Potthoff's statement that I belonged to the Duesseldorf ORG is also false. It is much more correct to say that I am not part of the Duesseldorf ORG, neither have I ever had any contact with it. I have never set foot in that ORG. I would not even know that the Duesseldorf ORG existed at all, and even today I am not aware of where it is located.
6. Another false assertion is that by 1985 I was well acquainted with Mrs. Adelheid Rech Gesche from the Scientology Center in Clearwater, Florida. That statement is pure conjecture. I met Mrs. Rech Gesche for the first time in Burgbrohl in 1985.
7. Another false assertion is that she had brought the entire "Helnwein Clan" on her "lines." First of all, there is no such thing as a Helnwein Clan, whatever that is supposed to mean. Furthermore, neither I nor my family

have ever been on any kind of "lines." I am an individualist and an artistic loner. Nor was there any attempt by Mrs. Rech Gesche to influence me to use my house for purposes of the Scientology Church.
8. Absolutely false and complete conjecture is the assertion: "The castle in which Helnwein lives in Burgbrohl has become a branch of the Celebrity Center in Duesseldorf ...". My castle was never a branch of any kind of organization, not Scientology nor any other kind.
9. Neither Mrs. Dr. Bardenheuer nor anybody else has taken any kind of course in my rooms at any point in time.
10. As far as the Summer Festival goes, that was supposed to be an open invitation for the inhabitants of the two villages and the acquaintances and friends of the studio to exhibit artistic works. That is all. Among the art crowd, open invitations are constantly given out for various exhibitions which are taking place at the same time in various galleries and art studios. For example: "Premiere" in Cologne, where every year a large number of galleries put on their exhibits together and invite the public without there being any kind of a connection between the galleries.
A whole lot of invitations were sent out for the Summer Festival, and of course each of those invited had the option of bringing friends and acquaintances along - whether members of the family or of the bowling league.
Mrs. Rech Gesche's written invitation to the members of her Celebrity Center took place without my knowledge and was wholly her own decision.
Only my artistic works were on exhibition at my house (Castle 2). In the other castle (Castle 1), works by artists Rudolf Kruspel Marina Kudlacek and Peter Schmitz were on display.

No kind of activity took place which had even the remotest thing to do with recruitment - either for Scientology or for any other purpose - not in the park nor in my castle.
On principle I have never done anything like that in my house and would not do that in the future. My house is and was always used exclusively as a studio and residence.
The persistently repeated assertion that there is a "clan" of painters around me is sheer fabrication by Mr. Potthoff, since it can be proved that from 1984 to today, that would be eight years, I have worked completely alone in my house in Burgbrohl and have barely had contact with other trained artists. With the exception of the three artists who have been living in my neighborhood for about two years off and on and with whom I have had only casual contact, I am not nor have I been acquainted with any other trained artists in all of Rheinland-Pfalz. I have not kept up contact with my former neighbor. I don't even know where they are staying now.
Besides my wife, there are two secretaries and three studio assistants who work here under normal work arrangements. None of these people is employed as an artist, and none of these people is or was a member of Scientology or has ever had, so far as I know, contact with Scientology.
I have not spoken a single time to my staff about Scientology.
11. Gruner & Jahr and GEO brazenly violated principles of journalism when they published this reader's letter and its gross accusations without review. And now this letter writer, Mr. Brosius, cannot even base his assertions on his own experience, because he is not acquainted with either me or my house. Therefore he is relying on Mr. Potthoff's assertions, who also does not know me, and on his latest information, which, according to what he himself said, he got seven years (!) ago from his former wife, Margit.

According to a sworn statement from his ex-wife, though, Margit Potthoff, she did not give this information allegedly about me at all. She was not in the position to do that, because outside of one or two fleeting contacts, she had not been informed about my affairs at any time.
So Gruner & Jahr relied on Brosius for his information, Brosius relied on Potthoff and Potthoff relied on alleged information from his former wife of six years ago, who did not verify his assertions in any case.
This can be looked at as a chain of second- and third-hand information which ends up going back to a conversation of two people from a shattered marriage of six or seven years ago. That is simply absurd.
I speak only rarely about my thoughts and views regarding worldview or philosophy; for one thing I don't like to tell everything I think to people, for another I have no desire to convince anybody else of anything on that subject. In my opinion, everybody should have his own view; therefore it is all the same to me what other people think.
Also, I have no office, post or function in any kind of religious society, political party or sect, no matter what kind. Furthermore no religious society, political party or sect is authorized by me to use a picture of my person, my art work, my verbal statements or written text for advertising purposes.

On appeal by the accused the decision of the 3rd Civil Chamber of the Frankfurt am Main State Court of 25 May 1995 is overturned.
The accused were ordered to cease from distributing or expressing verbally or perceptually the following assertion:

The complainant is not entitled to have a desist order issued in regard to most of the accused's expressed assertions analogous with P. 1004 Abs. 1 BGB in connection with PP. 823, Abs. 2 BGB, 186 StGB
As far as the complainant demanding the statements desist, he described himself as a clergyman, whether it is a genuinely honest assertion by the accused and whether this assertion is true is all the same, the complainant has himself to blame.
The accused may therefore leave the published statements in the press.
With the Federal Constitutional Court (NJW 1992, 1439), the Senate is also of the opinion that the requirements of the duty of presentation would be overtaxed if someone who expressed a derogatory assertion about a third party which did not come from his own realm of experience and exceeded his own capability of review could not rely on uncontested press releases. The Federal Constitutional Court indicates that for the individual serving the public interest it is regularly not possible

The accused referred to an interview which appeared in 1993 in the "Celebrity" magazine major issue 262. In it the complainant was described as an "Auditor IV."
An auditor is a clergyman in the sense of the terminology of the Scientology Church.
The accused may perceive this article as if the complainant described himself as an "auditor" and therefore as a clergyman. This description is found in the title of the complainant's interview. From that the impartial observer would have to conclude that the complainant was interviewed as a clergyman and had also given the reporter the impression that he was a clergyman.The accused may rely on this publication. It is, indeed, the Scientology Church's own publication and meant primarily for its members. At the same time it is publicly available.
People who rely on such publicly available sources can be ordered to desist or withdraw their statements if the article has been withdrawn or is recognizably outdated. (BVerfG, a.a.O.)Neither provision is fulfilled. The complainant did not present an outdated event, nor is one visible to the Senate. Neither has the assertion by "Celebrity" magazine been withdrawn. It seems rather questionable that the complainant turned to the Scientology Church Germany for the desist order when the article itself was neither written nor published by Scientology Church Germany. The complainant

16 U 163/95 - 5 -therefore could only have applied to the editorial staff of "Celebrity" magazine in the USA to have the assertion withdrawn. He indisputably did not do that.
Even so, the Scientology Church Germany, as has been revealed by the correspondence presented by the complainant, still did not sign a desist order nor did it have a retracting statement printed.
Therefore the complainant has not contradicted the publicly made assertion that he described himself as a clergyman.
On this same ground, the accused are not ordered to desist from stating that the complainant is an "Auditor IV" of the Scientology Church. That also applies to statements they had published in the press.
The accused are not ordered to desist from making the statement that the complainant belongs to a group which uses coercive hypnotic procedures with the help of a lie detector to destroy people's psyches to control them. This statement contains two elements. For one, it contains the assertion that the complainant is a member of a group, i.e., a member of the Scientology Church. For another is it asserted that this group uses coercive hypnotic procedures to control the consciousness of people.
The first part of the statement is an assertion of fact. This assertion is true, because the complainant is a Scientologist. In any case he professes to this organization. This can be concluded from numerous circumstances. For instance it states in the "College" magazine from 1975 that the complainant at that time said he had been a Scientologist since 1972. The Scientology Church had also sent out invitations to a summer festival with the complainant in 1986. It was stated in the magazine "Scientology

16 U 163/95 - 6 -heute" as well as in "Spiegel" that the complainant is a Scientologist. Also the presented list of Scientology "Patrons" has the complainant as a member of the organization. Also the complainant told Mrs. Melissa Mueller, a journalist, in 1991 that he was a Scientologist, and she then published that in a magazine "Cash Flow," without being contradicted by the complainant.
Besides that the complainant contributed to an advertisement in the "Frankfurter Allgemeinen" newspaper about the death of L. Ron Hubbard, the founder of the Scientology Church, and he did not oppose the statement by the accused that he was on a board of the Association of Responsibility-Conscious Businesspeople, Inc., a cover organization for the Scientology Church.
The second part of the statement concerns itself with the character of the Scientology Church. Not only the Scientology Church is involved with this statement, but also the complainant himself, since a poor light is also shed on him by the negative characterization of the Scientology Church.
Nevertheless the accused may express this assertion because they are relying for their information on the appropriate release from the standing conference of the Interior Ministers and Senators of the States from 6 May 1994. In this press release, the Scientology Organization was described, among other things, as one which conducted psycho-terrorism under the cloak of a religious society.
In view of these findings of the State Interior Ministers, there is no objection to the accused asserting that this organization employs a coercive hypnotic process and uses a lie detector.

16 U 163/95 - 7 -The Scientology Church did not contradict this publication by the State Interior Ministers. No retraction of its statements were demanded or published. Therefore the accused may assume correctness of the statement in this press release.
It plays no role that the publication of the press release happened only after the accused authored the open letter of March 3, 1994. In that regard the press release may only repeat that which has been long communicated by the agency responsible for defending against the danger, and also that which could be obtained from publicly accessible sources.
But even if that would not have been the case, the decision of the legal dispute at hand depends on the factual and legal situation at the point in time of the last oral hearing. Therefore, whether the accused at the time of the distribution of the open letter of March 3, 1994 could trust the rightness of what it said, can remain undecided, because they had learned the facts from other published communications. As to the question of whether the accused must be stopped from making their statements, or if they can trust press releases for what they say, that depends only on the situation at the time of the last oral hearing.
At that point in time, the uncontested press release from the State Interior Ministers Conference of May 6, 1994 was available.
The basic rights of the complainant have not been violated by the distribution of the statements under discussion. The complaint is able to use his general personality rights and his basic right to free exercise of religion in opposition to the basic rights of the accused to freedom of opinion.

16 U 163/95 - 8 -Nevertheless, in the case at hand, the interests of the accused prevail in their publication of the assertion that the complainant, as a clergyman, a Class IV Auditor and a Scientologist, belongs to an organization which employs psychological terrorism.
The complainant is an internationally known artist who has fallen into the public eye with his artistic works and actions. He has also stated that he was ready to cooperate with the artistic arrangements at the "Neue Bremm," a former Nazi era concentration camp in Saarbuecken. The question of whether the complainant will get this contract is of interest to the public. In connection with this, it is also of interest to the public of whether the complainant is a member of the Scientology Church and whether he has gotten so far as to obtain Class IV Auditor and what kind of an organization the Scientology Church is.
It should also be taken into consideration that the complainant, in numerous publications, has described himself as a Scientologist and a Class IV Auditor, and has been described as such by the press. Therefore the complainant has not exactly kept his membership and his concepts of Scientology a secret in the past.
But the complainant wants to stop the statement that there is evidence that the profits from a limited edition lithograph which is available in the Saarbruck Gallery will go to the Scientology secret service (OSA Munich). This statement is dealing with an assertion of fact. Indisputably, no money has yet gone to OSA. As can be seen from a letter from the chairman of the Scientology Church on May 7, 1992, the complainant stated that he was prepared to put one of his works of art on the market for the purpose of supporting Narconon and the OSA.

16 U 163/95 - 9 -The complainant only commented that the money was supposed to have been meant for Narconon. But when he learned that the money was being planned for other uses, he withdrew his statement. This was not explicitly contested by the accused. With their undisputed statement they only meant that the correctness of the assertion would be proven if the profits were to go to Narconon. It could not be excluded from the accused's statement that the complainant had only promised to have the profits go to the Narconon company. The words "demonstrably flow" define a description of a present event, and are not a statement of the complainant's intent.
Since this assertion is false, and the accused themselves do not maintain that money has already flowed, there is a claim to have them desist analogous to PP. 823 Abs. 2, 186 StGB, 1004 Abs. 1 BGB.
The decision of costs is based on P. 92 Abs. 1 ZPO. In doing that the Senate has considered that each of the four assertions from the complainant are of equal value.
The current execution of this decision is based on P. 709 ZPO

Patrons are Cohorts in Deed
Without any kind of objection on his part, from 1988 to 1992, that means over 5 (!) years, Gottfried Helnwein and his wife, Renate, were listed in the worldwide, bimonthly magazine published exclusively for Scientology members by the International Association for Scientologists, "Impact," on its "Patron" list, which is regarded as one of the great honors for a Scientologist.
"Patrons" like the Helnwein couple are 100% cohorts in deed, because their "donations" and other contributions are used to support the, in many cases criminal, goals of the IAS, which is directed by the OSA secret service, goals such as, e.g., combatting enemies of the organization with all means. They have a fanatical attitude toward Scientology. They are the ones who principally finance the deliberate media campaign against opponents of the "church" worldwide, and primarily in Germany against their host country.

The IAS Machine which Helnwein defendsThe most recent libelous text in the German language, "financed with the assistance of the International Association of Scientologists (IAS)," and thereby also directly by Renate and Gottfried Helnwein's "donations" as "patrons" and by their own membership contributions to the IAS (the IAS member numbers of the Helnwein couple are 38,764 and 38,765; in 1991 alone both paid a total of $6,000 to the IAS in England), published by the "Human Rights Office of the Scientology Church USA," produced "by an American attorney" (!) who is not named, flooded representatives of the German media in summer 1996.
The title of the 38-page OSA secret service pamphlet, which arrived with information and support from Helnwein, was "Religious Apartheid 1996, Suppression of the basic rights of religious minorities in Germany," copyright Church of Scientology International 1996, printed in the USA.
The most innocent victim of the evil German politicians and media was found in the third chapter under the title, "Cleansing" of the artists on page 10, it is: Gottfried Helnwein (!) from Burgbrohl.
Remarkable and certainly a surprise, since that was the first time that Gottfried Helnwein was publicly taken under the wing of his OSA colleagues, even though, since spring 1996, he allegedly "shit on Scientology," certainly not without the agreement of the supreme organizational direction of David Miscavige and thus without personal consequence for him, as a purely tactical means of continuing to commercially survive in Germany as a "secret Scientologist." Helnwein was framed, for the first time, as a "victim." In its article the OSA in Los Angeles wrote:
"Unfortunately the discrimination against Chick Corea (comment: he is also an OT VIII and, along with Julia Migenes, a walking Scientology musical billboard and a friend of Helnwein's since the beginning of the '70s) is not an isolated case, but is part of an unsettling escalation of intolerance by official positions in Germany against artists with whom a connection with Scientology is presumed, an intolerance which exists in crass contradiction to the fundamental artistic and religious rights of those affected.
